I gotta question: I was recently parked in a Burger King parking lot. I was in the backseats of my vehicle feeding my 5yr old daughter. I exited the vehicle and sat in my driver seat with the driver door opened as I poured some juice into a sippie. At that point a sheriff pulled up behind my parked car blocking me from leaving. He asked if it was my car, if i was on probation or parole and asked for my id. I walked over to him giving him my id. He ran my name nothing came up. He asked who I "run with"...me, being a mexican with a shaved head am use to these leading questions and answered it by saying I dont understand your question. I told him i dont run with anyone never have. I went to sit back in my car and he came to my window saying he had an issue with my license plates not coming back on his system...and asked for registration. He also asked if i had any "weed" or illegal weapons in the car which i didn't and then he shined his light through my windows and let me go. IS THIS LEGAL?

I saw on CSPAN that, and I quote, "WHEN A SUSPECT STARTS TO SPEAK HE HAS WAIVED HIS MIRANDA RIGHTS AND THERE IS NO LONGER ANY REQUIREMENT FOR AN ARRESTING OFFICER TO READ THEM TO A SUSPECT" (this can result in interrogation without a lawyer too) In other words they are now taking for granted that we all know those rights and if we say anything regardless of whether we were informed of our Miranda Rights we waive all of them. I think this was partly a knee jerk 9-11 reactionary thing. This has been in effect for 7 years or so now. I was, needless to say shocked, but not surprised, as we are and have lived in a police state since Weber V Maryland, and The Marijuana Tax Act, among other things. Playing morality police with alcohol, weed, etc has just filled prisons, made criminals out of decent people, and created a lot of jobs as enforcers for otherwise unemployable bullies, and jerks. (not all cops are in this category, but too may are) I do not advocate that meth should be unregulated and legal, or heroin, or cocaine but if it were of medically acceptable quality and pure without the weird cut, byproducts, contaminants, etc it would be a little safer. I can no longer go out in the desert south of town without fear of running into drug cartel smugglers, or bandits trying to rip off smugglers. The stuff these wet backs call heroin is not even fair quality morphine base, yet people are dying from it in ways that do not involve using it, or even being in the business of handling it. Thank you congress. Its really too bad an airliner did not take you SOBs out on 9-11 instead of innocent pawns you suck asses tax, oppress, draft into the military, and otherwise screw on a daily basis. The law makers should at least take the corporate penises out of their mouths when we speak to them. This goes for you jack offs at the state and local levels too! Now that we are supposed to know that we are Mirandized without actually having the rights told to us, and we are not sure if or when we are actually under arrest, the best course is to be courteous, volunteer nothing, but your name, address, and other ID related info, and from that point clam up. Where you are going, is none of their business. Refusing to answer this type of question can make these idiots angry, but is it relevant? Unfortunately I live in a state where you may be arrested for anything, everything and nothing at all. If they feel your ID is insufficient you are "under arrest for providing false ID" This has been true long before Az SB 1070. Why Arizona needed that? Politics, baby! It got our governor, with a rapist son who is in a mental hospital instead of prison where he belongs, elected. I have had to sit around for 3 hours waiting for the cops to get a dog to check my car for drugs when I refused to let them search it. They tried to forcibly take my car keys in the past, so I hide them in the dirt. It pisses them off and wastes our time, but the search is not mandatory without probable cause, which they immediately claim they have, but breaking into my car makes then responsible for damages. If you have drugs in your car I would not recommend this, but I quit 17 years ago, but still love to screw with them. Another reply when ask to search my car, is ask them to park the car by a dumpster. I keep my car like a city landfill inside. I ask them to just take everything out by the dumpster and say I will put back what I want to keep, aqnd throw away the rest, and thus they help me clean out my car. I did use this when carrying weed in the car. It worked every time. I still use this one too. My best advice is carry as little as you can, and be extra careful, but not paranoid. Cheers

if you are stoped for anything here is a card format that might help it also might get you arested but here it is"

"Officer, I mean no disrespect, but I understand my rights. I have the right to have an attorney present during questioning. I have a right to refuse to consent to any search of my body, and personal effects. I wish to exercise all my rights. If I am under arrest I wish to invoke and exercise my Miranda rights and be allowed the opportunity to obtain the advice of my attorney. If I am to be taken into custody I request a reasonable opportunity to make arrangements to secure my own property. I do not consent to any impoundment of my property. If I am not under arrest, I want to leave. If I am free to leave, please tell me immediately so that I may go about my business."

The writer of iloveweed.net has written a superior article. I got your point and there is nothing to argue about. It is like the following universal truth that you can not disagree with: The probability you will irrepairably stick your foot in your mouth is directly proportional to the attractiveness of the person you are trying to impress. I will be back.
